Terms and conditions of Use (My Personal Homepage)By Clicking on the box to give Parental Agreement, you, as your child’s parent and/or guardian agree to the terms and conditions of use below. These terms and conditions should be read in conjunction with the general Terms and Conditions of the MS Readathon. Personal information is collected in accordance with the Privacy Policy as outlined on this website. You agree to promote the MS Readathon and the services provided by MS Australia Personal HomepageYou and your child will together be able to create a Personal Homepage which displays a photograph of your child and states your child’s goals for the MS Readathon. The Personal Homepage must:
MS Australia may at its discretion and without notice to you, amend or remove the Personal Homepage if it believes that any of the requirements in these terms of use have not been complied with. The Personal Homepage page and all the content, information and data on it remains the property of MS Readathon. The Personal Homepage will remain ‘live’ from the time of creation until the end of September 2007 or a time otherwise determined by MS Australia. You must keep your password, required to modify the information on the Personal Homepage, strictly confidential to you. You not disclose the password to your child or family or friends. This is to ensure that you can control the content and modification of the Personal Homepage. MS Australia is not responsible for any loss of or damage to images, content, information or data on the Personal Homepage. MessagesThe Personal Homepage will allow you to send a ‘first invitation email’, a ‘reminder email’ and a ‘thank you email’ (Messages) to your family, friends and personal network from your email address. Messages must:
You take responsibility for to whom the ‘first invitation email’, the ‘reminder email’ and the ‘thank you email’ are sent by you. Because of subsequent forwarding by people to assist you with your fundraising, from this initial point there is no control over who is receiving the email containing the link to the Personal Homepage. For this reason the information that can be seen by clicking on the link by potential donors is limited and in no way discloses your child’s identity. By ‘agreeing’ you also acknowledge your responsibility to take every step to also protect your child’s identity. Computer VirusIf your use of the Personal Homepage or Messages or the loading up of materials on the Personal Homepage or receipt or sending of any emails results in the transmission of any computer virus, MS Australia will not be liable for any loss or damage suffered. It is your responsibility to carry out an appropriate virus check to ensure that the Personal Homepage, Messages and materials are free from viruses and other harmful code before using and/or accessing the Personal Homepage, Messages or materials. Confidential InformationAll content, information and data you have provided to MS Australia in relation to the Personal Homepage and its contents, information and data will in all instances remain confidential (except for content, information and data which is published on by you or your child on the Personal Homepage. Personal InformationPersonal information regarding you, your child, your family, friends and personal network may be collected in relation to the Personal Homepage and Message. Personal Information will not be shared with any other organisation. Only individuals directly related to the MS Readathon will have access to the personal information and then only for the express purpose of extending and improving the MS Readathon. Funds RaisedAll funds donated to set up and raised through the Personal Homepage will count towards your child’s eventual total fundraising in the MS Readathon 2007. Individual donations through the payment process are tax deductible. Donations must only be receipted once. If donations are made using the Personal Homepage and Message, the donor should be able to generate a receipt at the time of making the donation online. You should not need to write a separate physical receipt. If donations have been made by giving you the funds for you to pass on to MS Australia, you may write a physical receipt for the donor for their donation amount. The funds must not be remitted through the donation process online as this generates a second receipt which is not a true representation of the total sum actually donated. Such funds can be paid electronically through the Web Payments section of the MS Readathon web site. RewardsThe actual total of funds donated will define the Reward that is received by your child. To be eligible for Rewards, all sponsorship money, receipt book(s) and return forms must be received by MS Readathon, prompt delivery of the Rewards is only guaranteed if all items are received by the 30th of August 2007. All Rewards are awarded at the discretion of Multiple Sclerosis Australia. Multiple Sclerosis Australia reserves the right to award a Reward of equivalent value to the one offered. Rewards are not redeemable for cash. GeneralMS Australia may amend these terms and conditions from time to time without notice. These terms and conditions are governed by the laws of New South Wales, Australia. Parent AgreementI agree to assist, supervise and take responsibility for my child in setting up and maintaining their very own Personal Homepage on the MS Readathon Web site. I agree to the terms and conditions associated with setting up the Personal Homepage and I accept responsibility for any and all content, information, data, opinions and images that are posted onto the page and will ensure that they are appropriate and sympathetic to the MS Readathon and a children’s web page. |
